This Privacy Policy describes how Stadiumatch, Inc. (“Stadiumatch,” “we,” “our” or “us”) collects, uses, and discloses personal information about you and your data privacy rights. “Personal Information” is sometimes also referred to as personal data, personally identifiable information or other like terms that mean any information that directly or indirectly identifies you or is reasonably capable of being associated with you or your household. This Privacy Policy applies to Personal Information we collect online, such as when you visit our website, create an account on the Stadiumatch platform and list or bid on sponsorship opportunities (collectively, our “Services”), or when you otherwise interact with us, such as through our customer support channels or on social media pages. 

We may provide different or additional notices of our privacy practices with respect to other Personal Information collection practices not within the scope of this Privacy Policy, in which case this Privacy Policy will not apply.

1. Personal Information We Collect

A. Personal Information You Provide to Us

We collect Personal Information you provide directly to us. For example, we collect Personal Information directly from you when you register an account, create a profile as a school team, athletic team organization, sports complex, or sponsor, submit, bid on, accept or reject a sponsorship opportunity, or contact us for customer support or other inquiries. The types of Personal Information that we may collect directly from you include the following:

  • Account Registration: We collect information when you register for an Stadiumatch account, such as your name, email address, username and password.
  • Sports Organization Profile Information: We collect information you choose to provide in connection with your Stadiumatch profile, such as your organization type (school athletic program, club athletic program, or sports complex), school, club or sports complex name and address, shipping address, and additional details, such as school, club or sports complex logo, school classification, approximate number of students, school, club, or sports complex website, team name, team logo, sport, ages of athletes, approximate stadium or venue capacity, number of home games per season, team achievements, and percentage of student athletes that graduate. 
  • Sponsor Profile Information: We collect information you choose to provide in connection with your Stadiumatch profile, such as sponsor’s name, website, address, logo, sponsorship imagery, sponsorship preferences (e.g., states or sports of interest), and sponsorship types.
  • Social Media Information: If you choose to provide it, we collect and link to your social media (e.g., Instagram, Facebook, X (formerly Twitter), and/or LinkedIn) account username and follower count. 
  • Sponsorship Opportunities: We collect information regarding sponsorship opportunities created on the Stadiumatch platform, including the team, opportunity type, quantity, price, season start and end dates, offer visibility window, and status of the sponsorship opportunities.
  • Financial and Transactional Information: Our payment processor Stripe collects payment information to securely receive payment and send you the proceeds from offerings.

B. Information Automatically Collected

We automatically collect certain Personal Information about your interactions with us or our Services, including:

  • Device and Usage Information: We collect information about how you access our Services, including data about the device and network you use, such as your hardware model, operating system version, mobile network, IP address, unique device identifiers, browser type, and app version. We also collect information about your activity on our Services, such as access times, pages viewed, links clicked, and the page you visited before navigating to our Services.
  • Information Collected by Cookies and Similar Tracking Technologies: We use tracking technologies, such as cookies and web beacons, to collect information about you. Cookies are small data files stored on your hard drive or in device memory that help us improve our Services and your experience, see which areas and features of our Services are popular, and count visits. Web beacons (also known as “pixel tags” or “clear GIFs”) are electronic images that we use on our Services to help deliver cookies, count visits, and understand usage and campaign effectiveness. C. Information Provided by Other Sources

We obtain Personal Information from other sources. For example, we may collect information from identity verification providers to authenticate your email and identity when you create an account. 

2. How We Use Your Personal Information

We may use your Personal Information for the following purposes:

  • Provide, maintain, and improve our Services;
  • Authenticate your identity when creating an account;
  • Display your teams’ and organizations’ sponsorship opportunities;
  • Process sponsors’ requests and bids on sponsorship opportunities;
  • Conduct business dealings with our partners, service providers, contractors or processors;
  • Process transactions and send you related information, including confirmations, invoices, and customer experience surveys;
  • Personalize and improve your experience on our Services;
  • Send you support and administrative messages; 
  • Respond to your comments and questions and provide customer service;
  • Monitor and analyze trends, usage, and activities in connection with our Services; 
  • Detect, investigate, and prevent security incidents and other malicious, deceptive, fraudulent, or illegal activity and protect the rights and property of Stadiumatch and others;
  • Debug to identify and repair errors in our Services; 
  • Comply with our legal and financial obligations; and
  • Carry out any other purpose described to you at the time the information was collected.

3. How We Disclose Your Personal Information

We may disclose your Personal Information in the following circumstances or as otherwise described in this Privacy Policy.

  • Our Service Providers, Contractors and Processors: We disclose or make available information to service providers, contractors and processors that need access to your information to perform services for us, such as companies that assist us with emails, web hosting, identity verification, cloud infrastructure, security, analytics, and payment processing.
  • Sold or Shared: We do not sell or share Personal Information.
  • Legal Disclosures: We may disclose Personal Information if we believe that disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements. We may also share Personal Information if we believe that your actions are inconsistent with our user agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of Stadiumatch, our users, the public, or others.
  • Disclosed to Advisors and Lawyers: We may disclose Personal Information with our lawyers and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests.
  • Disclosed During Change of Ownership: We may disclose Personal Information in connection with, or during negotiations concerning, any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.
  • With Your Consent: We may disclose Personal Information with your consent or at your direction.
  • Disclosure of Non-Personal Information: We may also retain or disclose aggregated or de-identified information that cannot reasonably be used to identify you. When doing so, we publicly commit to maintain and use the information in an aggregated or de-identified form and not attempt to re-identify the information, unless permitted or required by law. 

4. How We Retain Your Personal Information

We store Personal Information associated with your account for as long as your account remains active. If you close your account, we will delete your account data. We store other Personal Information for as long as necessary to carry out the purposes for which we originally collected it and for other legitimate business purposes, including to meet our legal, regulatory, or other compliance obligations.

5. Analytics

We allow others to provide analytics services on our behalf. These entities may use cookies, web beacons, device identifiers, and other technologies to collect information about your use of our Services and other websites and applications, including your IP address, web browser, mobile network information, pages viewed, time spent on pages, links clicked, and conversion information. This information may be used by us and others to, among other things, analyze and track data, determine the popularity of certain content, and better understand your online activity. 

6. Children

The Services are not intended for or directed at children under the age of 18. In addition, we do not knowingly collect Personal Information from children under the age of 18. We also do not knowingly sell, share, use for targeted advertising or disclose the Personal Information of children under the age of 18.

7. Your Choices

A. Account Information 

You may update and correct certain account information at any time by logging into your account or emailing us at support@stadiumatch.com. If you wish to delete your account, please visit the Security & Privacy tab in Account Settings, but note that we may retain certain information as required by law or for our legitimate business purposes.

B. Cookies

Most web browsers are set to accept cookies by default. If you prefer, you can usually adjust your browser settings to remove or reject browser cookies. Please note that removing or rejecting cookies could affect the availability and functionality of our Services. 

C. Communication Preferences

You may opt out of receiving promotional emails from Stadiumatch by following the instructions in those communications. If you opt out, we may still send you non-promotional emails, such as those about your account or our ongoing business relations.

D. Do Not Track

Some browsers have incorporated “Do Not Track” features. Most of these features, when turned on, send a signal or preference to the websites you visit indicating that you do not wish to be tracked. Because there is not yet a common understanding of how to interpret the do not track signal, we currently do not respond to the browser do not track signals. 

E. Automated Processing and Profiling
